Marcus Brackinridge, 38, was shot to death on April 13, 2014, in the backyard of his parents’ home in Daly City, California. The shooting happened about 5:50 a.m.; Brackinridge was naked when he was shot in the stomach and head. His mother witnessed the attack through sliding glass doors and screamed; she was then shot in the abdomen and wounded.

Authorities say the shooter was Demond Anthony Spikes and that the confrontation arose over money owed to a prostitute who was present. Spikes and the woman fled the scene but were later taken into custody. The case went to trial on charges including first-degree murder, shooting at an inhabited dwelling and firearm possession; evidence at trial included Spikes’s prior strikes under California’s three-strikes law.
