Justin Phillips, a 32-year-old white man, was shot and killed on May 25, 2019, at a residence in Fort McCoy, Florida. Deputies say Phillips was visiting the home of 62-year-old John Spooner with a third man, John Daniels; the three had reportedly been drinking beer and smoking marijuana together for about six months. An argument between Spooner and Daniels escalated, and Spooner retrieved a firearm from his shed.

Spooner told investigators that Phillips, who was larger and younger, advanced on him despite being told to stop; Spooner, who weighed about 120 pounds and reported a heart condition and a brain aneurysm, shot Phillips once in the face. Phillips’ body was found outside the home when deputies arrived.Spooner cooperated with police, provided a blood sample, surrendered the gun and a bag of cannabis, and appeared impaired at the time. Investigators conducted a re-enactment that they said matched Spooner’s account, while Daniels gave inconsistent statements.

Assistant State Attorney Rich Buxman reviewed the evidence and concluded Spooner acted in self-defense under Florida’s Stand Your Ground law, so no charges were filed. Why do readers think the physical evidence and witness accounts produced such different interpretations of what happened that night?
