Mallory D. Moton, a 40-year-old Black male, was shot and killed in Ocala, Florida, on February 17, 2016. Officers arrived at 1307 Northwest 12th Avenue about 8:09 p.m. and found Moton on the ground with multiple gunshot wounds. He received first aid and was taken to a local hospital but died of his injuries.

Investigators say the shooting grew out of an altercation at a location described as the gambling house. Christopher Foster, 28, was at the house when an argument occurred. Witnesses reported Moton left but returned shortly with a handgun; as Moton approached Foster and another person he allegedly made a motion with the gun. Foster then drew his weapon and fired four shots at Moton. Foster claimed he acted in self-defense.

The State Attorney’s Office reviewed the evidence and determined Foster was immune from prosecution under Florida’s self-defense laws, citing Moton’s aggressive behavior and witness statements that he had a gun and made a motion as if to use it. Does anyone have details about the scene or the people present that could shed more light on what happened?
