Wendy Johnson, 39, was found dead in Buchanan, Georgia on July 24, 2017, the result of a single gunshot to her right shoulder that proved fatal after striking vital organs. The investigation focused on her boyfriend, James Stewart, who was arrested and charged with malice murder, felony murder predicated on aggravated assault, aggravated assault, and discharging a firearm while under the influence.
At trial Stewart’s defense argued the shooting was an accident. The jury acquitted him of malice murder but convicted him of felony murder and aggravated assault; the court imposed a life sentence without the possibility of parole on the felony murder conviction. An appeal challenged the verdict form, counsel’s effectiveness, and whether the aggravated assault sentence should merge with the felony murder conviction. The state’s highest court vacated the aggravated assault sentence but upheld the felony murder conviction and life sentence.
Wendy’s death had a profound effect on the Buchanan community. If anyone knew Wendy or has information about her final days, please share what you can.
