On May 6, 2017, bystanders in a wooded area of Covington, Georgia reported seeing smoke. Responding officers found the body of 62-year-old Michael Avon Williams, a man who was experiencing homelessness, on fire. An initial examination at the scene showed he had also suffered a head injury; an officer used a fire extinguisher to put out the flames.

Investigators identified 39-year-old Benjamin Marcus Johnson of Covington as the person allegedly involved after interviews with two witnesses. Police arrested Johnson that same evening near a Family Dollar after stopping a vehicle he was riding in. He was booked on charges of murder, concealing the death of another, and arson. The investigation was conducted by the Covington Police Department and the Georgia Bureau of Investigation, and a magistrate court judge found sufficient evidence to bind the case over for trial.
