On the night of May 20, 2013, a gathering in a garage on Cimwood Drive in Harvey, Louisiana, ended with 23-year-old Robert Casbon shot in the chest. He was taken to a nearby hospital and pronounced dead in the early hours of May 21. Present at the garage were Phillip McClendon, 28, and another man; investigators focused on McClendon and later arrested him. McClendon said the shooting was an accident, and he was booked on negligent homicide and being a felon in possession of a handgun. The handgun itself was not recovered.

At the time of the incident McClendon was on parole for a prior narcotics violation and aggravated battery.
