Trooper Mark Jeffrey Phebus, 23, was shot and killed on September 17, 1990, on FM 1774 near Magnolia in Montgomery County, Texas. He was off-duty and returning home after a weekend out of town when he stopped at what he believed was a vehicle crash. After identifying himself and asking the woman involved to find a phone to call 911, he was shot by the male subject who remained at the scene.

The weapon was a .44 caliber handgun. A capital murder warrant was issued for the male subject, but the man committed suicide before he could be arrested. Trooper Phebus had served with the Texas Highway Patrol for seven months and was survived by his parents. The death cut short a career colleagues described as just beginning.
