Sergeant Elio Diaz, an 11-year veteran of the Charlotte County Sheriff’s Office, was killed during a traffic stop on December 15, 2024, in Port Charlotte, Florida. Around 3:00 p.m. Diaz pulled over a white pickup at a Chevron on Tamiami Trail for a license plate showing a financial responsibility suspension. The driver, 24-year-old Andrew Mostyn Jr., was living out of the uninsured vehicle. Sgt. Diaz spent more than an hour trying to help Mostyn reinstate insurance to avoid towing; the interaction was described as cordial with no visible aggression or weapons.
As Diaz returned to Mostyn’s truck after working in his patrol car, Mostyn allegedly produced a Romarm SAR-1 rifle and shot the sergeant multiple times. Mostyn fled but was later found at a Popeye’s parking lot near I-75 and Kings Highway wearing a ballistic vest with steel plates. Deputies say Mostyn reached for the rifle and was fatally shot by deputies. Diaz was taken to ShorePoint Health Port Charlotte, where he died. He is survived by his wife and four children; Governor Ron DeSantis ordered flags at half-staff on December 20, 2024. Packets of mushrooms were recovered from Mostyn’s truck and his family reported prior mental health issues and drug use.
What details about that afternoon or the people involved might help explain how a routine stop became deadly?
