Charles Keith Harris, known as Charlie, was 42 when he was shot and killed at his Booneville, Kentucky, apartment on March 22, 2017. Two officers — former Owsley County Sheriff Kelly Shouse and Deputy Michael Havicus — went to the residence after a call from Harris’s girlfriend alleging he had shoved her and might have knives. Harris refused them entry; the officers entered and followed him to a bedroom, where they say they found him armed with a knife. Deputy Havicus says he fired one shot when Harris lunged at him, and the wound proved fatal. Two of Harris’s children were in the home during the encounter. A grand jury declined to bring criminal charges.
The estate and Harris’s children later sued. A federal judge found the sheriff and deputy had created a needlessly violent confrontation and entered the apartment illegally, criticizing their disregard for limits on police power, but ruled that a jury must decide whether the shooting itself was reasonable. The officers’ lawyers say they had consent to enter and that Harris escalated the situation. Does anyone have direct information about the entry to the apartment or what happened in the moments before the shot?
