Carlos D. Marshall was 22 when he was shot to death in Winchester, Virginia, on August 17, 1994. The bullet that killed him was reportedly too damaged to be ballistically matched to the weapon Washington was alleged to have been carrying.
Jeffrey Washington, a young Army veteran, was arrested after the killing. The arrest warrant sworn by a Winchester police detective claimed evidence linking Washington to the murder, but at a preliminary hearing ten days later the same detective testified he had no witnesses or forensic evidence tying Washington to the crime. Rudolph Powell Jr. later pleaded guilty to second-degree murder in Marshall’s death and was sentenced to 25 years in prison.
Questions about the prosecution’s handling of Washington’s case followed after then-Commonwealth’s Attorney Paul Thomson faced unrelated federal charges and professional discipline years later. Washington’s family has sought to have his conviction reviewed amid allegations of an unlawful arrest and a missing court transcript. Does anyone have information about the 1994 investigation or the subsequent legal proceedings?
