On the evening of Thursday, January 9, 1975, Marshall Hamilton, a local septic tank business owner in Virginia Beach, was found suffering from a gunshot wound at about 7:20 pm. The injury proved fatal. He was described as having black and grey hair.

Virginia Beach police treated the shooting as a homicide and believed several people were in the area when the attack occurred. No arrests had been announced and the identity of any suspect or suspects remained unknown; the investigation was still open.
