Max Levine, 25, of Kokomo, Indiana, was fatally shot in the early morning hours of May 24, 2014, in a grassy parking and camping area near the Indianapolis Motor Speedway known as the Coke Lot. He had been with a group of friends when an argument broke out and the dispute escalated to gunfire.
Speedway police arrested 19-year-old Avory Johnson of Indianapolis and he was initially charged with murder and held without bond in the Marion County Jail. Days later the preliminary murder charge was dropped and Johnson was released after the Marion County Prosecutor’s Office concluded there were major inconsistencies in suspect identification. Investigators acknowledged a serious lineup error: witnesses who should have been kept separate were allowed to mingle, which tainted the identification process. Johnson remained a person of interest but no one was charged at that time.
Levine’s family was left without legal closure after the release. If anyone was in the Coke Lot that night or has information about what led to the shooting, please come forward.
