Michael Kelly, a 20-year-old resident of San Pablo, California, was tragically shot to death on May 10, 2014. The incident occurred around 9:20 p.m. outside a residence on the 1300 block of Stanton Avenue. Witnesses reported seeing a dark-colored SUV pull up, a window roll down, and a shooter fire several bullets, striking Kelly multiple times. This drive-by shooting was a shocking event for the community and led to an extensive investigation by local authorities.
The investigation
revealed that the shooting was gang-related. Alexis Herrera and Juan Cortez were charged with murder and gang enhancements in connection with Kelly's death. Prosecutors alleged that both Herrera and Cortez were members of a street gang based in Northern California. The motive for the shooting was linked to derogatory comments Kelly had made about one of their friends who had been killed in an unrelated incident earlier in 2014. Additionally, it was discovered that Kelly had previously given information to the police implicating Herrera in a burglary, which had caused animosity between them.
A third defendant, who had initially confessed to driving a stolen car used during the killing, had his charges dismissed after a Contra Costa judge ruled that his confession was inadmissible. The confession was deemed involuntary because it was obtained under the promise of leniency by San Pablo police Sgt. Shawn Ray. This ruling significantly weakened the case against Herrera and Cortez, although they continued to deny any involvement in the killing.
Despite the challenges in the legal proceedings, the case against Herrera and Cortez proceeded. The police investigation included video evidence of Kelly making threatening comments about Herrera and Cortez, referring to them by their nicknames. Additionally, minutes before the shooting, Cortez was seen driving by in a different car, and he was suspected of giving the SUV’s driver and Herrera a ride from the area after they ditched the stolen car used in the shooting.
