Eduardo Salguero, an 18-year-old from San Diego, California, tragically lost his life on November 25, 2020. The incident occurred during a planned meeting to purchase a ghost gun, which Salguero had arranged via Snapchat. He and a friend drove to a parking lot behind a Vons supermarket on Midway Drive to meet the supposed sellers. Upon arrival, the suspects, Angel Garcia and Armando Alvarado, entered Salguero's vehicle and demanded money at gunpoint.
During the confrontation, Salguero was shot in the back while behind the wheel, causing the car to crash into a retaining wall. His friend managed to escape the scene, but Salguero was found behind the wheel and later pronounced dead at the hospital.
The investigation quickly led to the arrests of Garcia and Alvarado, who were charged with murder, attempted murder, and a special-circumstance allegation of committing the murder during a robbery. The prosecution presented evidence including cell phone records related to the gun sale, DNA evidence found in Salguero's car, and statements made during an undercover jail operation. This evidence tied the defendants to the crime, leading to their conviction and sentencing to life without parole.
However, in December 2024, a state appellate court panel overturned the murder convictions of Garcia and Alvarado. The court ruled that the jury should not have been allowed to hear gang-related evidence during the trial, as it was deemed prejudicial and not necessary to prove their involvement in the shooting and robbery. The appellate justices stated that the inclusion of this evidence harmed the credibility of the defendants' claims that Salguero's friend had pulled out a realistic-looking BB gun during the hold-up. The ruling has left the possibility of a retrial uncertain, as the court's decision emphasized the prejudicial impact of the gang evidence on the jury's verdict.
