Alberto Alejandro Calvillo, a 24-year-old Latino, was tragically shot and killed on November 6, 2016, in Baldwin Park, California. The incident occurred around 11:10 p.m. outside a restaurant on Ramona Boulevard. Calvillo and his fiancée were standing outside the establishment when a verbal altercation erupted between Calvillo and two men, Omar Valenzuela Perez and his nephew, Eric Perez. The argument began after the men used disrespectful language that offended Calvillo's fiancée.
In response, Calvillo asked them to show some respect. The situation escalated when Omar instructed Eric to retrieve a gun from their car. Eric complied, handing the firearm to Omar, who then shot Calvillo multiple times in the upper torso. Calvillo was rushed to a nearby hospital but was pronounced dead at 11:52 p.m.
Following the shooting, the suspects fled the scene in a dark-colored sedan. However, a Baldwin Park police officer quickly located and detained them a few miles from the restaurant. Witnesses at the scene identified Omar and Eric Perez as the perpetrators, and a handgun was found in their vehicle. Both men were arrested and charged with murder on November 9, 2016. Omar Valenzuela Perez, 24, and Eric Perez, 21, were held on bail amounts of $2.01 million and $1 million, respectively.
The legal proceedings against Omar and Eric Perez culminated in their convictions for first-degree murder. On October 22, 2018, a jury found both men guilty, and they were subsequently sentenced to life in prison. The court found that Eric Perez's actions, including retrieving and handing the gun to his uncle, significantly aided and encouraged the murder. Despite their attempts to appeal the convictions, arguing insufficient evidence and various trial errors, the Court of Appeal upheld the verdicts on January 28, 2021. The appellate court rejected the defense's claims, affirming that the evidence presented at trial was sufficient to support the first-degree murder convictions. The court also noted that Eric Perez's fear of potential harm from Calvillo and the influence of drugs did not justify their actions.
