Gustavo Segura Acosta, a 36-year-old resident of Fresno, California, died on September 22, 2014, following a confrontation with law enforcement officers. The incident occurred after Acosta had been exhibiting increasingly erratic and threatening behavior towards his wife, leading to significant concern from the Fresno Police Department. On September 18, 2014, Acosta was served with a restraining order due to a physical altercation with his wife in late July.
This order was intended to keep him away from his wife for three years. However, Acosta's behavior did not improve; he was arrested on the same day for possession of methamphetamine but was released the following day.
Upon his release, Acosta continued to violate the restraining order by visiting his wife's home and sending her threatening messages. His actions included recording a video outside her window at night, which he sent to her, causing her significant distress and fear. This prompted the police to take further action. On the night of September 22, 2014, officers went to a residence near Kirk and Grove Avenues to arrest Acosta for violating the restraining order. They found him in the backyard, armed with a metal pole and wearing part of a five-gallon bucket on his torso. Despite being shot with a less-lethal bean bag shotgun and a Taser, Acosta continued to advance towards the officers with the pole raised. The officers, fearing for their safety, fired ten shots at Acosta, resulting in his death at the scene.
The investigation into Acosta's death revealed that he had a history of mental health issues and had stopped taking his medications in December 2013. He had self-admitted into mental health facilities five times in the six months leading up to his death. The police officers involved in the shooting were not charged, as the investigation concluded that they acted in self-defense given the immediate threat posed by Acosta. The case highlighted the challenges faced by law enforcement when dealing with individuals with severe mental health issues and the tragic outcomes that can result from such encounters.
