Jeff Estime, a 23-year-old male from Delray Beach, FL, was fatally shot on December 4, 2020. The incident occurred in a neighborhood near Military Trail and Lake Ida Road. Estime was driving slowly past another vehicle when Bachir Osias, a 43-year-old man, fired three shots at him from a car window. The encounter lasted only about five seconds, ending with Estime crashing his car into a mailbox.
Passersby found him slumped forward in the driver's seat, bleeding from his torso, wrist, and above the lip.
Osias claimed he acted in self-defense, alleging that Estime had pointed a gun at him first. However, prosecutors argued there was no evidence that Estime had a gun at the time of the shooting. Osias had purchased the gun used in the shooting just one week prior. He was arrested three days after the incident on an outstanding warrant from a previous assault charge. During the arrest, the gun used to kill Estime was found tucked in Osias' waistband.
Osias' defense team attempted to use Florida's "stand your ground" law to dismiss the murder charge, but the judge denied this request, stating there was no evidence to support Osias' claim that Estime had a gun. The jury was left to decide whether Osias' use of force was justified based on Estime's reputation and physical abilities, as well as the likelihood that Osias feared for his life during their encounter.
After deliberating for four hours, the jury convicted Osias of the lesser charge of manslaughter with a weapon, a first-degree felony. He faces up to 30 years in prison. The sentencing was scheduled for September 9. This case highlights the complexities and challenges of self-defense claims under the "stand your ground" law, particularly when there is a lack of evidence to support the defendant's assertions.
